Abu Dhabi Introduces New Rules for Housing Gift Transfers

The recent introduction of new regulations regarding the transfer of gifts in housing grants in Abu Dhabi marks a significant advancement in the management of real estate transactions. The “New Regulations for the Transfer of Gifts in Housing Grants in Abu Dhabi” aim to clarify and streamline the process, ensuring that rights are safeguarded while enhancing transparency throughout the transaction. This initiative aligns with the directives of His Highness Sheikh Khaled bin Mohamed bin Zayed Al Nahyan, Crown Prince of Abu Dhabi and Chairman of the Abu Dhabi Executive Council, and represents a collaborative effort between various governmental bodies to improve real estate governance.

A Unified Approach to Housing Grants

In collaboration with the Abu Dhabi Judicial Department and the Abu Dhabi Housing Authority, the Abu Dhabi Real Estate Center (ADREC) has launched a new service designed to regulate the process of transferring gifts related to housing grants. This initiative establishes a unified pathway for residents that begins with the application process and continues through to legal documentation. By integrating the roles of these three governmental entities, the new regulations ensure that all steps involved in the “New Regulations for the Transfer of Gifts in Housing Grants in Abu Dhabi” are clear and accessible.

Specific Conditions and Documentation Requirements

The newly established framework outlines both general and specific conditions that must be met for the transfer of housing grants. Transfers are exclusively permitted between spouses and first-degree relatives, thereby limiting the scope of transactions to immediate family. Additional conditions include the necessity to fulfill documentation requirements, adherence to legal processes established by the judicial authority in Abu Dhabi, and ensuring that no financial obligations or encumbrances exist before completing the transfer. Moreover, there are specifications regarding the type of ownership, such as a requirement for construction completion that meets a minimum percentage in certain cases.

Addressing Special Circumstances

These regulations also take into consideration exceptional situations that may affect the transfer process. For instance, scenarios involving minors among the owners, situations where one partner or adult child may refuse consent, or desires from the recipient to maintain shared ownership are all accommodated within this updated regulatory framework. Special cases that include ownership outside the emirate or properties categorized under particular classifications are also addressed.

Steps to Simplify the Process

The process has been designed to be user-friendly, comprising six key steps that facilitate the experience. Initially, individuals begin by submitting their request through the Abu Dhabi Judicial Department. Next, an electronic verification is conducted to ensure no restrictions are placed on the gifted property. The third step involves issuing the gift declaration by the judicial department to the ADREC to continue with the procedures. Subsequently, the benefactor must sign a declaration indicating that they will not seek another grant or transfer any alternate residential property. Following this, the spouse and adult children must provide their consent to the transfer. Finally, the recipient must sign a declaration affirming their commitment not to sell or lease the property.

Through these “New Regulations for the Transfer of Gifts in Housing Grants in Abu Dhabi,” Abu Dhabi is setting a precedent for effective governance and transparency in housing grants, ultimately contributing to a more robust and accountable real estate environment.
