Habtoor Group Initiates International Arbitration Over Lebanese Investment

The Al Habtoor Group is preparing to initiate international arbitration regarding its investment dispute with the Lebanese government, having officially appointed the law firm White & Case to represent them. This development highlights the growing tensions surrounding investment relations between the UAE and Lebanon, underscoring the necessity for effective legal recourse in addressing corporate grievances in the region.

In an official statement, the Al Habtoor Group announced that it has entered the final phase of preparing for international arbitration proceedings in Washington, D.C. This move aligns with the dispute resolution mechanisms outlined in the bilateral investment agreement between the United Arab Emirates and Lebanon, adhering to international frameworks governing investment protection.

The group emphasized that this decision follows the expiration of a six-month cooling-off period specified in the treaty, during which the Lebanese authorities failed to take any corrective actions or propose substantial settlements, despite being informed of serious breaches and damages. “All investments by the Al Habtoor Group in Lebanon were made in good faith, based on Lebanese laws and binding international obligations,” the statement asserted. The group also expressed that it had exercised considerable restraint and sought a peaceful resolution over an extended period, providing ample opportunity for resolution under the treaty framework.

However, the continuation of institutional paralysis and the absence of effective remedial measures have left the Al Habtoor Group with no choice but to pursue formal legal channels to enforce its rights and seek recovery in accordance with international law. The group remains open to any serious and organized settlement initiatives that would restore its full rights and compensate for incurred damages, while noting that preparations for the arbitration process have reached an advanced stage.

The Al Habtoor Group underscored the significance of investor protection, treaty adherence, and the respect of international legal obligations as fundamental pillars of economic credibility. Their actions not only represent an effort to reclaim rights but also embody a principled commitment to the rule of law and the sanctity of foreign investments. The group asserted its intention to keep stakeholders and the public informed about updates as the arbitration proceedings progress.
