Man Ordered to Pay 2.5 Million Dirhams After 11 Years

In a significant ruling, the Dubai Civil Court has mandated an Arab national to pay 2.5 million dirhams to another party, the sum owed for a loan taken in 2015 to facilitate the payment for goods related to the borrower’s business. The loan was formally documented with a cheque of the same amount, which unfortunately bounced when presented to the bank due to signature discrepancies and other deficiencies. The individual who issued the cheque received a three-year prison sentence for this offence.

The Background of the Dispute

The legal conflict traces back to 2015 when the defendant requested a loan of 2.5 million dirhams from the plaintiff, citing urgent liquidity needs to settle the costs of merchandise. The loan was agreed upon, with the defendant promising repayment upon the sale of the goods, leading the plaintiff to provide the requested funds.

The Cheque Incident

In return, the defendant issued a bank cheque worth 2.5 million dirhams, drawn from the account of his owned business, as supposed repayment for the loan. However, when the plaintiff attempted to cash the cheque, it was returned due to signature discrepancies and other misspecifications.

Legal Proceedings and Developments

The matter escalated beyond the failed cheque when the plaintiff pursued criminal charges against the defendant. Consequently, the case was forwarded to the criminal court, which in 2015 sentenced the defendant to three years in prison. Although the criminal proceedings were eventually extinguished due to the statute of limitations, the initial debt remained a pertinent issue for the plaintiff, who later returned to civil court to seek compensation for the outstanding amount.

The Civil Court’s Ruling

This year, the plaintiff revived the lawsuit, demanding repayment of the original 2.5 million dirhams alongside legal interest calculated at 5% from the date it became due until full settlement. During the hearings, the plaintiff submitted multiple documents, including a copy of the defendant’s business licence, the bounced cheque, and a bank statement confirming its return, along with evidence indicating the expiration of the criminal matter.

No Defence Presented

The defendant, despite being duly notified, failed to attend court proceedings and did not provide any evidence of repayment or dispute the documents presented by the plaintiff. This lack of response led the court to investigate the fundamental nature of the debt and assess whether the issuance of the cheque sufficed to extinguish the financial obligation.

Key Findings and Legal Principles

The court affirmed that a cheque fundamentally serves as a payment instrument and must be associated with a legitimate and lawful obligation to pay the amount to the beneficiary. It reinforced that merely issuing and handing over a cheque does not absolve the issuer from their liability unless it can be proven that the beneficiary has indeed received payment.

The court noted that any party claiming the cheque lacked lawful grounds or was issued as a guarantee carries the burden of proof, as they assert a position contrary to the established norm. In applying this legal principle to the case, the court found no evidence indicating that the cheque was issued without legitimate cause or that the plaintiff had failed in his obligations regarding the transaction.

Conclusion of the Case

As a result of examining the provided evidence, and in light of the absence of any defense or proof of repayment from the defendant, the court concluded that the debt remained valid. The defendant was ordered to repay the plaintiff 2.5 million dirhams along with 5% annual legal interest from the date of the cheque until full repayment, in addition to covering court fees and a fee of 1,000 dirhams for legal costs.
