Man Scams Young Man and Steals 107,500 Dirhams for a Car

In a striking incident that highlights the risks associated with financial transactions and informal contracts, the Al Ain Court ordered a man to return 107,500 dirhams to a young man who had given him the money to purchase a car and ship it abroad. However, the man breached the agreement and refused to return the funds. A young man filed a lawsuit against another individual, demanding payment of 107,500 dirhams along with a legal interest rate of 5% from the date of filing until full payment is made. The young man also sought a material and moral compensation of 10,000 dirhams, as well as a request for a decisive oath to be taken by the defendant, along with an order for the defendant to cover the case fees and expenses. According to the young man’s claim, an agreement was made to purchase a car from the UAE and ship it to his home country. He transferred the amount to the defendant’s bank account; however, the latter did not fulfill the agreement or buy the car and refused to refund the amount after several amicable requests, causing both material and moral damage to the plaintiff. He supported his claim with documents, including a copy of the bank transfer notification.

Court Decisions

Before ruling on the case, the court decided to present the decisive oath to the defendant, which stated: “I swear by Almighty God that there was no agreement between me and the plaintiff, either directly or through others, and that I did not agree with him to purchase a vehicle from the United Arab Emirates and ship it abroad for the benefit of the plaintiff, and that I did not receive from him the amount of 107,500 dirhams in execution of this agreement or for this purpose.” However, the defendant did not attend the relevant session, and the court established his notification.

Legal Outcomes

The court confirmed in its ruling that the defendant’s absence from taking the decisive oath constitutes a denial, thereby proving the facts stipulated in the oath. Consequently, the court established that the defendant owed 107,500 dirhams and had not refunded it. Regarding the request for legal interest, the court clarified that late interest compensates for the delay in fulfilling a monetary obligation. Since the amount demanded was known and established as owed by the defendant, the court ordered him to pay the amount along with a legal interest rate of 5% annually until full payment is made. Additionally, the court ordered him to pay 5,000 dirhams as compensation, as well as to bear the case fees and expenses.
