Fraud Claims Surface in 2.2 Million Dirham Check Scandal

Forgery Allegations and Claims of Manipulation in a 2.2 Million Dirham Payment Document

In a controversial legal case, two individuals of Arab nationality filed an appeal against a payment document valued at 2.2 million dirhams, claiming it had been subject to “forgery” through the illegal addition of zeros. This allegation includes claims that the document was manipulated to increase its original value from 200,000 dirhams to over two million dirhams. As the case progressed, the court decided to dismiss the lawsuit, citing a lack of seriousness and legal standing.

Details of the Manipulation Allegation

The plaintiffs alleged that the amount was forged by adding zeros using ink different from the rest of the information recorded in the document. They requested the court to compel the defendants to present the original document and to refer it to the forensic laboratory of Dubai Police for ink analysis and verification of the signature. However, the court confirmed that the case lacked serious elements.

Background of the Case

The events of the case date back to restructuring agreements made in 2016 and 2018, concerning the construction of residential rooms on specific parcels of land. Under these agreements, a debt exceeding 11.4 million dirhams was modified to be repaid through 24 equal checks. Nevertheless, the plaintiffs claimed that the defendants failed to fulfill their obligations, prompting them to seek legal recourse.

Court Reactions

Upon reviewing the case, the defendants argued for the dismissal of the lawsuit on the grounds that it was filed against individuals without legal standing. They pointed out that the original document was not in their possession but rather with the plaintiffs, who had only provided a carbon copy. After considering all aspects of the case and the submitted documents, the court affirmed that a forgery claim does not gain acceptance if the document is contested in an ongoing lawsuit, thus turning the allegation into a defense mechanism.

Final Outcome

Based on the presented evidence, the court deemed the forgery appeal to lack seriousness due to the absence of genuine legal interests from the plaintiffs in compelling the defendants to provide the missing original document. The court’s decision resulted in the dismissal of the lawsuit, with the plaintiffs bearing the costs of the legal proceedings.
