Dubai Court Mandates Service Fee Payment Prior to Handover

In a significant move aimed at enhancing clarity within Dubai‘s real estate sector, a recent court ruling has established that property buyers are required to pay service fees from the moment a project is completed, even prior to the official handover. This decision by the Dubai Rental Disputes Centre addresses long-standing uncertainties, defining responsibilities between developers and buyers regarding shared facility costs. The ruling, encapsulated in the new judicial principle, marks a crucial step in streamlining property management and ensuring uninterrupted services for jointly owned buildings.

The Rental Disputes Centre has laid down a clear framework stating that unit owners are accountable for service charges starting from the date of project completion, a clarification that was sorely needed in the past. This ruling seeks to resolve persistent disagreements between developers and buyers concerning who should bear the costs of maintaining communal facilities.

Dubai Rental Disputes Centre’s Role

This ruling is anchored in Law No. (6) of 2019, which governs obligations around jointly owned properties. This legislation highlights that either the developer or the owner must cover charges related to unsold units, ensuring that management companies receive the necessary funds for the ongoing operation and upkeep of shared spaces. Though the law was fundamentally sound, disputes often arose when units sold on installment plans were completed yet remained unregistered in the buyer’s name, leading to conflicting views on payment responsibilities.

Developers frequently delayed handover due to outstanding dues, provoking questions about service charge liabilities. In light of these ongoing disputes, the Rental Disputes Centre escalated the issue to the General Authority for Unifying Principles. Ultimately, the Authority confirmed that the buyer listed in the preliminary register is obligated to start paying service fees from the completion date, even without the final ownership transfer.

Key Insights from the Ruling

Judge Abdulqader Mousa Mohammed, the President of the Rental Disputes Centre, commented on the importance of this ruling, saying, “The General Authority has addressed this legislative gap by interpreting the law’s underlying intent to secure the stability of jointly owned properties and guarantee the uninterrupted provision of essential services.” He emphasized that holding buyers accountable for service charges aligns with the original spirit of the legislation.

This landmark ruling not only establishes a clear legal precedent but also reinforces the confidence of property owners within Dubai’s real estate landscape. It plays a vital role in ensuring that essential building services continue without interruption, protecting those owners who fulfill their obligations and closing potential loopholes that might weaken community integrity.

The ruling amplifies the Rental Disputes Centre’s authority in interpreting laws related to property ownership, adapting to the changing realities of real estate practices. This legal clarity serves to bolster Dubai’s reputation as a leading global investment hub. In a related development, the Centre successfully closed 49,817 execution files associated with joint ownership in 2024, marking notable progress in resolving issues tied to property management.

Additionally, a self-execution service for service fee claims has been introduced, enabling property management companies to handle claims more efficiently. This innovation ensures not just continuity of services but also enhances the overall management processes of buildings. With this ruling, Dubai continues to set a precedent in the area of property management and ownership rights, paving the way for smoother transactions and a more stable real estate environment.
