The Dubai International Financial Centre (DIFC) has released a consultation paper proposing amendments to the property ownership law aimed at updating the laws and regulations related to property ownership within the financial centre. This initiative seeks to enhance transparency and flexibility in property management, reflecting the centre’s commitment to meeting the evolving needs of investors and facilitating real estate operations. The purpose of these amendments is to create a more effective legal framework that aligns with modern economic and social developments.
Details of the Proposed Amendments
The DIFC announced a series of important amendments to the property ownership law. In this context, Jack Fisar, Chief Executive Officer for Legal Affairs at the Centre Authority, stated that the amendments aim to “ensure our legal framework is updated to meet the evolving needs of the centre’s community.” This statement reflects the centre’s vision of capturing market signals and providing effective legal solutions.
Increased Legal Liability for Contractors
One of the key points included in the consultation paper is the imposition of a ten-year liability on contractors towards developers for defects that may arise in new buildings within ten years of completion. This step aligns with Article 880 of the UAE Civil Transactions Law, aiming to protect investors’ rights and enhance confidence in the real estate sector.
Improvement of Property Registration Procedures
The amendments also plan to extend the lease registration period from 30 to 45 days, along with extending the period for registering off-plan unit sales and paying freehold transfer fees from 30 to 60 days. Additionally, a penalty fee will be imposed for failing to register a lease agreement, while the fee for requesting a stay on legal proceedings will be eliminated. These amendments reflect the centre’s effort to improve efficiency and reduce complexities that stakeholders may face in real estate transactions.
Next Steps
With the release of the consultation paper for amendments to the property ownership law, the DIFC aims to gather feedback from the community and investors to ensure that the proposed amendments align with market needs. Engaging with the community is considered an important step to ensure the success of these amendments and to better shape the future of the real estate sector in Dubai.
