Biker Injured as Two Vehicles Collide from Wrong Parking

A recent judgment by the Dubai Traffic Court has led to significant penalties for two drivers involved in a motorcycle accident that resulted in injuries and property damage. The case highlights critical road safety issues stemming from improper vehicle positioning and inadequate attention while driving.

Incident Details

The incident occurred in the Bur Dubai area when a vehicle was improperly parked, leaving part of it protruding into the traffic lane. The driver failed to take necessary precautions to secure the area or to alert other road users. A motorcyclist approaching from behind did not maintain a safe distance and, as a result, collided with the stationary vehicle, leading to physical injuries for the motorcyclist and damage to both the motorcycle and the vehicle.

Legal Proceedings

The Public Prosecution referred both drivers to the Traffic Court. The driver of the vehicle faced charges for causing injury to the motorcyclist and damaging property due to negligence. Meanwhile, the motorcyclist was also held partially responsible for not paying attention and failing to keep a safe distance while riding.

Court Rulings

During court proceedings, the motorcyclist admitted to his fault, whereas the driver of the vehicle was absent despite being duly notified. Consequently, the court delivered a verdict in his absence. The court confirmed that the driver had breached traffic safety rules by stopping in a hazardous location and failing to ensure that his vehicle was safely out of the traffic flow. It was also confirmed that the motorcyclist played a role in causing the accident due to inattentiveness and inadequate spacing.

Penalties Imposed

Based on the evidence presented, which included the defendants’ admissions recorded in investigation reports, the court found both parties accountable. The vehicle driver was fined 2,000 AED for the two charges against him, while the motorcyclist received a fine of 1,000 AED, which has been suspended for three years, recognising that his circumstances suggest he is unlikely to reoffend.

The court’s decision underscores the importance of adhering to road safety regulations to prevent similar incidents in the future.
