Abu Dhabi Mandates Occupancy Certificates for Buildings Over 30 Years

Abu Dhabi’s Department of Municipalities and Transport has mandated that owners of commercial buildings and villas over 30 years old obtain an occupancy certificate. This requirement is aimed at ensuring these structures are ready for occupancy and meet approved safety and public health standards.

Deadline Extension for Owners

The deadline for owners to comply was initially set for 16 September but has been extended to 30 November. This additional time allows property owners to complete the necessary procedures and submit applications through the electronic municipal licensing system.

Importance of the Occupancy Certificate

An occupancy certificate is an official document issued by the relevant municipality confirming that a building is suitable for occupancy and use based on established requirements. Operating or using a building without a valid certificate is prohibited, with the certificate generally valid for up to five years, depending on the type of building and nature of its use.

Eligibility and Requirements

According to the municipality, specific buildings over 30 years old are subject to the requirements for the occupancy certificate. This certificate is granted after verifying that the building is ready for use and adheres to safety, construction quality, and approved regulations.

The buildings affected include commercial, residential, and investment villas, as well as any structures with a technical report from an accredited planning and licensing authority indicating structural defects that could impact public safety. However, residential villas privately owned by individuals, public housing, industrial and government buildings, and public facilities are currently exempt from this requirement.

Call to Action for Property Owners

The department urges property owners, investors, or managers of commercial buildings and investment villas that have surpassed the 30-year mark to initiate the process of obtaining the occupancy certificate within the specified timeframe. It is advisable to consult with a classified consulting office to ensure all required procedures are completed properly.
