Influencer fined $22,000, phone seized over restaurant defamation

In an age dominated by screens and constant uploads, the line between criticism and defamation can be crossed in an instant. Abu Dhabi Judicial Department has highlighted one such case in its “Stories and Lessons” series, showing how a brief video posted online can carry serious legal and financial consequences when it moves from comment to reputational harm.

A complaint after a video posted online

The case began when an influencer on a social media platform pointed her phone camera at a well-known restaurant. The recording was not used to review the food or assess the quality of service, but instead contained offensive remarks that attacked the integrity of the owner and the way he managed the business.

Faced with what he considered a direct online assault on both his personal reputation and his commercial project, the restaurant owner did not remain silent. He immediately turned to the competent authorities and filed an official complaint, stressing that the published video had gone beyond expressing an opinion and caused him substantial moral and material damage to the reputation and standing he had built over years.

The investigation and the court’s finding

When the defendant was summoned and confronted with the recorded material, she admitted in the evidence report and during public prosecution investigations that she had filmed the restaurant and posted the video on her personal account. She said her intention had been “criticism”, but investigators concluded that the wording used exceeded the limits of objective assessment.

Authorities found that the content amounted to direct insult and fell within the scope of defamation and slander through technical means, because it targeted people and honour rather than evaluating a product or service.

Financial and legal consequences

After the case was heard by the competent court, it issued a ruling fining her 30,000 dirhams, ordering the deletion of the offensive clip, and confiscating the phone used in the incident on the grounds that it was the instrument of the offence.

The matter did not end with the criminal penalty. The court also ordered the defendant to pay 51,000 dirhams in temporary civil compensation to the injured party, bringing the total cost of that single act of defamation to 81,000 dirhams.

It was a costly reminder that online visibility does not make abuse acceptable, and that reputation is not content for digital publication.
