New Penalty Regulations Seek to Strengthen Compliance Efforts

Starting from April 14, 2026, the Federal Tax Authority has implemented Cabinet Decision No. (129) of 2025, which amends certain provisions of Cabinet Decision No. (40) of 2017 regarding administrative fines for violations of tax legislation in the UAE. This initiative marks a significant step toward encouraging compliance among taxpayers and alleviating their financial burdens, allowing them to rectify any tax-related discrepancies that may exist. By fostering a more business-friendly environment, the aim is to enhance the competitiveness of the UAE in the global marketplace. The new adjustments not only ease the compliance process for businesses but also aim to promote voluntary adherence to tax regulations.

Enhancements for Tax Compliance

The Federal Tax Authority emphasized that the updated legislative framework is designed to provide greater support for taxpayers. These changes are essential for enabling businesses to meet their tax obligations more efficiently. “The new amendments, which include reductions in many administrative fines imposed for tax violations, align with the directives of our leadership to implement a tax system that adheres to the best standards,” stated Abdulaziz Mohammed Al-Mulla, Director General of the Federal Tax Authority. This statement underscores the intention to create a transparent and flexible regulatory environment, thereby encouraging businesses to maintain compliance.

Encouraging Voluntary Disclosure

According to the Federal Tax Authority, these changes significantly reduce the financial penalties associated with non-compliance. For instance, the fines for failing to provide the necessary tax-related documents in Arabic have been lowered from 20,000 AED to just 5,000 AED. Furthermore, the penalty for not notifying the authority about situations requiring updates to tax records has been modified. Previously, fines would accumulate to 5,000 AED for a first-time offense and 10,000 AED for repeated infractions. With the new decision, taxpayers now face either 1,000 AED for a single violation or 5,000 AED for repeat violations within a 24-month period. This innovative approach aims to motivate taxpayers to report discrepancies voluntarily.

Comprehensive Adjustments to Administrative Fines

The adjustments introduced by the Federal Tax Authority also encompass a wide range of violations related to tax compliance. Notably, fines associated with failing to pay owed taxes on time, submitting incorrect tax returns, or not informing the authority about errors have all seen significant revisions. The intent is to not only minimize penalties but to instill a culture of compliance among registered taxpayers. For instance, the fine for a legal representative failing to report their appointment has been reduced from 10,000 AED to just 1,000 AED, further emphasizing the Authority’s commitment to promoting an environment conducive to business growth.

Overall, the enhancements brought about by the implementation of Cabinet Decision No. (129) concerning administrative fines illustrate a proactive approach by the UAE government. These amendments serve not only to reduce economic burdens but also establish a framework that fosters voluntary compliance among taxpayers. The Federal Tax Authority encourages all registered businesses to take advantage of these changes to ensure the accuracy of their tax records and strengthen their role in the UAE’s dynamic economic landscape.
