“Mental Illness” Reduces Sentence for Defendant Driving Under the Influence of Drugs

In a controversial case, the Ras Al Khaimah Court of Appeals decided to reduce the sentence for a defendant who drove a vehicle under the influence of drugs, taking into account his mental health condition. The case involved a reduction of the fine and the ruling for the release of the seized phone, after the defendant indicated that a mental illness affected his behavior. This ruling demonstrates how mental illnesses can influence judicial decisions related to drug offenses.

Details of the Incident

The defendant was initially stopped while driving on one of the roads in Ras Al Khaimah, where authorities suspected his condition. After legal procedures were initiated for arrest and search, medical analysis results showed the presence of two prohibited psychoactive substances. By this time, the case had been referred to the public prosecution for investigation.

During the interrogation, the defendant confirmed that he suffers from psychological disorders and is receiving treatment through prescriptions, which could explain the positive results in the lab tests. He sought to clarify how he used the medications for treatment and emphasized that he had not consumed any substances for non-medical purposes.

Initial Ruling

The first-instance court issued its ruling convicting the defendant, imposing a fine of 20,000 dirhams for the drug use charge and 5,000 dirhams for the driving under the influence charge, in addition to confiscating the mobile phone. However, the defendant did not give up; he appealed the ruling, calling for a reconsideration of his case.

In his appeal, the defendant stated that his mental illness caused severe fatigue and anxiety, affecting his ability to work and sleep, ultimately leading to seizures and loss of consciousness. He also mentioned that he had been diagnosed with depression and was receiving the necessary treatment.

Legal Defense and Appeal

The defendant’s lawyer, Hanan Al-Shamili, presented a strong defense, pointing out that the medications taken by the defendant were for therapeutic purposes and under the supervision of licensed doctors. She also asserted that his drug use was legal, denying any criminal intent. Furthermore, she argued that it was not proven that the mobile phone was used to obtain illegal substances.

The lawyer used parts of legal precedents to support her argument that the essential elements of the crime were not present. Indeed, the Court of Appeals accepted some of these arguments and decided to amend the ruling.

Final Ruling

In its final decision, the court found grounds for reducing the penalty. Consequently, the defendant’s fine related to the drug use charge was reduced to 10,000 dirhams, and the confiscation of the phone was canceled. The court confirmed that confiscation as an additional penalty must be proven to have been used in committing the crime, which was not established in this case.

This ruling highlights how the judicial system addresses cases related to mental health, reflecting the importance of considering these issues in legal decision-making processes and their impact on individuals’ rights.
