Dubai Court Orders Three to Pay 2.1 Million Dirhams to Woman

In a significant ruling, the Civil Court of Dubai has ordered three individuals to collectively pay 2.1 million dirhams, plus an annual interest rate of 5%, to a woman following their failure to execute a settlement agreement. This case highlights the legal implications of adherence to pacts made in the context of civil disputes.

Background of the Case

The plaintiff initiated a criminal case against one of the defendants, alleging fraud, breach of trust, and forgery. As the criminal proceedings unfolded, the parties engaged in negotiations that culminated in a settlement agreement reached in April 2026. According to this agreement, the defendant and two co-defendants committed to pay the plaintiff 2.1 million dirhams via cheque, in exchange for her withdrawal of the complaint and the criminal case.

Failure to Comply with the Settlement

Despite the plaintiff’s compliance with the terms of the agreement, including her formal withdrawal of the complaint submitted to the public prosecution, the defendants failed to deliver the original cheque or make any payment despite her repeated requests. Furthermore, upon following up with the public prosecution, the plaintiff discovered that the funds supposedly held in her favour were actually a financial guarantee related to procedures regarding one of the defendant’s travel restrictions. This revelation reinforced her claims that the defendants did not fulfil their obligations under the settlement agreement.

Court’s Findings and Rationale

In its decision, the court rejected the defendants’ arguments challenging its jurisdiction, clarifying that the dispute pertained not to a rental relationship or lease contract but to the enforcement of an independent financial obligation arising from the settlement agreement. The court also dismissed their request to suspend proceedings pending the resolution of the criminal case, underscoring its commitment to uphold the sanctity of contractual agreements.

This ruling serves as a reminder of the legal enforceability of settlement agreements in civil matters and the importance of adhering to such commitments. The court’s determination to ensure justice was served reinforces the role of legal frameworks in resolving disputes amicably.
