New Wage Protection System Launches Tomorrow

Tomorrow Marks the Implementation of the New Wage Protection System in the Private Sector

The United Arab Emirates will witness the implementation of the new wage protection system in the private sector starting tomorrow. This important step aims to enhance workers’ rights and ensure timely payment of wages. The system includes specific mechanisms and deadlines for salary payments, contributing to increased transparency and compliance among private establishments. The “Wage Protection in the Private Sector” initiative is a key element in improving the work environment, as it seeks to protect workers’ rights and guarantee their payments on time.

Mechanism for Implementing the New System

The Ministry of Human Resources and Emiratisation announced that the new wage protection system, which stipulates that the first day of each Gregorian month will be a fixed deadline for the payment of workers’ wages, will come into effect tomorrow. Any payment made after this date will be considered a delay, requiring all establishments to adhere to the specified deadlines. This system applies to all establishments registered with the ministry, which must provide the necessary documents to prove the payment of workers’ wages according to the established criteria.

Stages of Compliance Assessment

The new wage protection system outlines controls and regulatory procedures related to assessing the compliance of establishments. An establishment is required to transfer at least 85% of the total wages due to workers by the deadline. A worker is considered to have received their wage as long as they receive at least this percentage, while retaining the right to claim any outstanding amounts. In cases of delayed wage payments, the procedures involve several stages, starting from electronic monitoring of compliance to taking legal action against repeated violations.

Penalties for Delay and Their Impact on Establishments

The new wage protection system establishes a range of penalties that may be applied in cases of delayed wage payments. The procedures begin with electronic monitoring, followed by notifications sent to non-compliant establishments. If the delay exceeds 11 days, administrative fines are imposed, and the establishment may be classified in a lower category based on the frequency of violations. If the delay exceeds 16 days, labor disputes may be registered, especially if the establishment has 25 or more workers.

Exceptions to the New System

The new wage protection system includes certain exceptions regarding the calculation of wages, such as workers with labor claims under judicial consideration or those who have been informed of a lack of work. There are also exceptions for seafarers, short-term workers, and those receiving wages from external companies. This aspect is part of efforts to provide comprehensive protection for all categories of workers in the market.

These measures serve as an incentive to promote a culture of compliance in the private sector, as the new wage protection system clearly aims to improve working conditions and secure workers’ rights, thereby contributing to the stability of the local labor market.
